2. SUBJECT MATTER, SCOPE AND TERM

This Legal Notice sets forth the general terms governing access to, browsing and use of the web pages comprising the Website hosted at the URL https://www.aldeasfilms.com. Any person who browses, accesses or uses the Website shall be considered a user (hereinafter, the "User").

Notwithstanding the foregoing, access to certain content or services that may be provided in the future may be subject to specific terms which, as applicable, shall supplement, amend, and/or modify the general terms herein contained. In case of conflict between these terms and the specific ones, the specific terms shall prevail.

ALDEAS reserves the right to alter the layout, settings, and content of the Website, or the conditions for accessing and/or using it, at any time and without prior notice. It also reserves the right to suspend, interrupt, or terminate access to the Website's content, with no entitlement for the User to claim any compensation.

The validity of this Legal Notice is therefore limited to the period during which it is displayed, and shall remain in effect until it is amended, either in whole or in part. At that point, the new Legal Notice made available to Users shall take effect.

By accessing, browsing, and using the Website, a User explicitly and unconditionally accepts all the terms set out herein, including any specific terms that may apply to the access or use of any part of the Website. These terms shall be deemed as valid and enforceable as if they were part of a written and executed contract.

3. ACCESS

Access to the Website is prohibited for minors unless they have obtained prior and express authorisation from their parents, guardians, or legal representatives, who shall be responsible for any actions taken by the minors under their care, in accordance with applicable regulations. In any event, it shall be presumed that a minor’s access to the Website has been made with the prior and express consent of their parents, guardians, or legal representatives.

The Website can be used free of charge. However, the User shall bear any costs incurred through the relevant telecommunications network.

ALDEAS reserves the right to deny or withdraw access to the Website and/or the services provided through it (including but not limited to any accounts created by the User, should this possibility arise in the future) without prior notice, either at its own discretion or at the request of a third party, to any User who fails to comply with the provisions included in this Legal Notice or any other current or future document applicable thereto (such as the Website’s Data Protection Policy or Cookie Policy).

4. USE

The User acknowledges and expressly agrees that the use of the Website is solely and exclusively his/her responsibility. He/she undertakes to use it in compliance with the law and this Legal Notice, and accepts any risks or damages that may result from such use.

ALDEAS shall endeavour to ensure that the content of the Website is of the highest possible quality and reasonably up-to-date. However, it does not in any way guarantee its accuracy, completeness, relevance, and/or timeliness.

By using the Website, the User agrees not to engage in any conduct that could damage the reputation, interests, or rights of ALDEAS or any third parties, or that could harm, disable, or overload the Website. Neither shall the User engage in any actions that could otherwise hinder the normal use of the Website in any way. Should the User negligently or wilfully fail to comply with any of the provisions set forth in this Legal Notice, he/she shall be liable for any damages or losses that may result from such non-compliance to ALDEAS.

The User shall refrain from:

A) Making unauthorised or fraudulent use of the Website and/or its contents for illegal purposes or effects, as prohibited in this Legal Notice, or in a manner that infringes third parties´ rights and interests. The User shall neither make any use of the Website and/or its contents that would in any way hinder, render useless, overload, deteriorate or impede the normal use of the services or the documents, files or all types of contents stored in any computer equipment.

B) Accessing or attempting to access resources or restricted areas of the Website, without complying with the terms required for such access.

C) Causing any damage to the physical or logical systems of the Website, its suppliers or third parties.

D) Introducing or disseminating computer viruses or any other physical or logical systems that may cause damage to the physical or logical systems of ALDEAS, its suppliers or third parties.

E) Attempting to access, use and/or manipulate any data from ALDEAS, third party providers and other Users.

F) Reproducing or copying, distributing, or allowing public access through any form of public communication, or transforming or modifying the contents displayed on the Website, unless authorised by the owner of the rights or except where such actions are legally permitted.

G) Deleting, hiding or manipulating the notes on intellectual or industrial property rights and other data identifying the rights of ALDEAS or other third parties, which may be incorporated into the contents displayed on the Website, including any technical protection devices or information systems that may be inserted in the contents.

H) Obtaining or attempting to obtain the content by means or procedures other than those which, as the case may be, have been made available for that purpose.

I) Using the Website in any way to disclose or make available to third parties any statements, opinions, information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of content or statement that:

• Is contrary in any way to, undermines, or infringes the fundamental rights and public freedoms recognised in the Constitution, International Treaties and in any other applicable laws.

• Induces, entices or promotes criminal, offensive, defamatory or violent actions or, in general, any actions contrary to the law, morality, generally accepted good customs or public order.

• Includes any kind of unsolicited advertising.

• Induces, entices or promotes discriminatory actions, attitudes or thoughts on grounds of sex, race, religion, beliefs, age or status, or incites to engage in practices that are dangerous, hazardous or harmful to health and mental well-being.

• Is contrary to the honour, personal and family privacy, or self-image of individuals.

• Incorporates, makes available or allows access to products, items, messages and/or services that are of a criminal, violent, offensive, harmful or degrading nature, or, in general, contrary to the law, morality, generally accepted good customs or public order.

• Is protected by any intellectual or industrial property laws applicable to ALDEAS or any third parties, without the required authorisation for the intended use.

• Includes any type of virus or programme hindering the normal functioning of the Website.

Should the User be provided with a password to access any of the services and/or contents of the Website offered at present or in the future, he/she undertakes to use it diligently and keep it secret at all times. Consequently, he/she shall be responsible for its proper custody and confidentiality and undertakes not to assign it (or allow access to it) to any third parties, either temporarily or permanently. The User undertakes to notify ALDEAS of any event that may result in the unlawful use of his/her password, including but not limited to, any theft, loss, or unauthorised access, for ALDEAS to cancel it immediately. Therefore, until such notice is served, ALDEAS shall not be held liable for any liability that may arise from the improper use of such password. The User shall bear full responsibility for any unlawful use of the password by any unauthorised third party in connection with the content and/or services or access provided on the Website.

ALDEAS states that it has taken the necessary measures within its capabilities and in line with the state of technology to ensure the functioning of the Website and detect any viruses and other components that may be harmful to the equipment or devices of Users. Notwithstanding the foregoing, the User must be aware that the security measures of computer systems on the Internet are not entirely reliable. As such, ALDEAS cannot guarantee the absence of viruses or other issues that may cause alterations to the User's computer systems (software and hardware), or to the electronic documents and files stored therein. The User shall therefore be responsible for any risk or damages that may arise from accessing the Website and shall hold ALDEAS harmless in this regard. It is the User's responsibility, in any case, to implement any required tools in the equipment and devices to detect and deactivate any harmful computer programmes.

5.  LINKED SITES

5.1. ELinks on other websites directing to the Website.

Any User, entity or website/page wishing to create a link to the Website may only link to its homepage, unless expressly authorised in writing by ALDEAS. Furthermore, the link must be complete so that it takes the User to the URL address of the Website and must fully cover the entire screen area of the Website's home page.

Under no circumstances is it permitted to create frames of any kind around the Website or to display its content through different Internet addresses. Additionally, in the event that such content is displayed alongside content from outside the Website, it shall not: (i) cause error, confusion or mislead Users as to its true origin, (ii) involve unfair comparison or imitation, (iii) take advantage of the brand´s reputation and ALDEA´s prestige, or that of those who appear or produce content displayed on the Website, or (iv) display the content in any other manner that contravenes applicable law.

Creating a link does not imply the existence of any legal relationship between ALDEAS and the owner of the third-party website, nor does it entail ALDEAS´ acceptance, approval, sponsorship, verification, or supervision of its content or services. 

ALDEAS does not authorise the creation of links to the Website from third-party websites that contain materials, information, or content that is unlawful, illegal, inappropriate, or contrary to morality, public order, generally accepted social norms, or religious principles, and which may be displayed or promoted on the Website. However, ALDEAS lacks the human or technical means to monitor or control all information, content, products, or services provided by third-party websites linking to the Website.  ALDEAS shall therefore not be held liable for any issue related to such third-party websites.

ALDEAS reserves the right to prohibit or disable, at any time and with immediate effect, any link to the Website, particularly in cases where the activity or content of the third-party website containing the link is unlawful. Should Users become aware of any illegal activities conducted through such third-party websites, they are kindly requested to notify ALDEAS immediately so that the access link may be disabled.

5.2.  Links to other websites.

The Website may occasionally provide Users with links that allow access to websites or Internet portals owned or managed by third parties (hereinafter, the "Linked Sites").

The creation of any link from the Website to a third party website does not necessarily imply the existence of any relationship, collaboration, or dependency between ALDEAS and the entity responsible for the Linked Site. Therefore, ALDEAS shall not be held liable for any issues related to the Linked Site, including, but not limited to, its operation, access, data, information, files, the quality and reliability of its products and services, its own links, and/or any of its content. Consequently, the User shall assume sole responsibility for navigating such sites.

Should Users become aware of any illegal activities conducted through such Linked Sites, they are kindly requested to notify ALDEAS immediately so that the access link may be disabled. 

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

Under no circumstances shall it be understood that the User's access to and browsing of the Website implies a waiver, granting of a licence, or total or partial transfer of any intellectual or industrial property rights over the Website or any of its core components (including but not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audio-visual content, as well as its graphic design and source codes). Accordingly, no exploitation rights recognised under the applicable law are transferred to the User. The reproduction, alteration, distribution, public disclosure, making available, reuse, resending or any other exercise of such rights by any means or procedures is expressly prohibited to the User, unless legally permitted or authorised by the rights holder.

References to names and trade or registered marks, logos, or other distinctive signs, whether owned by ALDEAS or third-party companies (whether or not they are ALDEAS affiliate companies), which may appear on the Website, implicitly include a prohibition on their use if ALDEAS´ or the rightful owners´ consent is not granted. Except as expressly stated, access to or use of the Website does not grant the User any rights over the trademarks, logos, and/or distinctive signs contained therein and protected by law.

The User may view and obtain a temporary private copy of the Website content for his or her exclusive personal and private use on his or her computer systems (software and hardware), provided that this is not for the purpose of carrying out any activities of a commercial or professional nature. The User must refrain from obtaining, or attempting to obtain the contents by means or procedures other than those made available to him/her in each case, or those normally used on the Internet. The User shall at all times comply with all intellectual and industrial property rights over the Website, whether owned by ALDEAS or third parties.

The content and information made available to the User by ALDEAS on the Website may originate from both own and third party sources. Should the User become aware of any content that is unlawful, illegal, contrary to the law, or that could be regarded as an infringement of any intellectual and/or industrial property rights, he/she must immediately notify ALDEAS so that the appropriate measures may be taken. 

In the event that the User sends information of any kind to ALDEAS through the Website using the channels provided for this purpose, he/she acknowledges, guarantees and accepts that he/she is entitled to do so freely, that such information does not infringe any intellectual property rights, trademark, trade secret, or any other third party rights, and that it is neither confidential nor harmful to third parties. Therefore, the User acknowledges and agrees to accept responsibility for any information he/she may provide, either personally or on his/her behalf, and agrees to hold ALDEAS harmless against any issues arising therefrom, including its accuracy, lawfulness, originality, and ownership.

7. DATA PROTECTION

In order to make use of some of the services or options allowed on the Website (e.g. contact form), the User must first provide certain personal data that shall be processed by ALDEAS in compliance with the applicable regulations on this matter, i.e. Regulation (EU) 2016/679, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter, the "GDPR"), and Organic Law 3/2018, of 5 December, on the protection of personal data and guarantee of digital rights (hereinafter, abbreviated to "LOPDGDDD" in Spanish).

9. RESPONSIBILITY

ALDEAS does not guarantee uninterrupted access, nor the proper display, download, or functionality of the information contained in pages linked to this Website. Such access may be impeded, hindered, or interrupted by factors or circumstances beyond its control. Accordingly, ALDEAS shall not be liable for any damages or loss incurred by the User arising from failures or disconnections in the telecommunications networks, leading to the suspension, cancellation, or interruption of access to the Website.

ALDEAS reserves the right to remove, in whole or in part, any content or information available on the Website.

ALDEAS may suspend the service or immediately terminate any relationship with the User if it becomes aware that the use by such User of the Website or any of the services offered therein breaches any provision set forth in the Legal Notice, Data Protection Policy, or any other applicable terms.

ALDEAS shall not be held liable (i) for any damages, loss, claims, or expenses arising from the use of the Website, and shall solely be responsible for promptly removing any content that may cause such harm, provided it has been duly notified; nor (ii) for any decisions made by the User resulting from any access to the content or information available through linked sites.

10. APPLICABLE LAW AND JURISDICTION

This Website is governed by Spanish law.

In order to settle any dispute or discrepancy that may arise in relation to the validity, construction, application, execution, non-fulfilment or nullity of the provisions contained in this Legal Notice, ALDEAS and the User of the Website expressly agree to submit themselves to the jurisdiction of the competent Courts of Madrid capital city, expressly waiving any other jurisdiction they may be entitled to.
